The Workshop

VENDOR TERMS AND CONDITIONS
These terms apply to every vendor at The Makers’ Market at The Workshop ("the Market"), Sunday, November 29, 10 am to 3 pm, at The Workshop, 300 Allen St., Austin, TX 78702. By submitting the application and signing, you agree to them.
1. Eligibility and selection

  1. The Market is open to vendors with a connection to or interest in The Workshop.

  2. Submitting an application does not guarantee a space. We give preference to vendors who apply first, and we make sure the Market has a balance of categories.

  3. Handmade work you create yourself comes first. You may also sell artisan-made goods by other creators.

  4. We allow a limited number of vendors who showcase only services and do not sell products. Service vendors pay the same vendor fee and must carry the licenses and insurance that apply to their services.

  5. Application due date has been extended to Nov 8. We will email vendor acceptance decisions within 1 week of application.

2. Fees and payment

  1. The vendor fee is $75. You are not charged when you apply.

  2. If you are accepted, we will email payment instructions (credit card, Zelle or Venmo).

  3. To confirm your spot, pay the fee within 1 week of acceptance email. If the fee is not paid by the deadline, your spot moves to the waitlist.

3. Cancellations and refunds

  1. Vendor fees are not refundable, because spaces are limited and vendors are selected through an application process.

  2. If the Market is completely cancelled, your vendor fee will be refunded.

  3. If the Market is rescheduled, we will make a one-on-one decision with any vendor who cannot attend the new date.

4. Weather

  1. We make weather decisions the evening before the event and notify all vendors by email.

  2. If weather prevents an outside market, we will try to move everyone indoors. Indoor space will not be a 10x10 space.

  3. If we cannot move the Market indoors, we will reschedule it (see Section 3).

5. Schedule, setup and teardown

  • 8:30 am: vendor setup begins.

  • 10 am to 3 pm: the Market is open. Booths stay set up until 3 pm.

  • By 4 pm: teardown is complete.

6. Load-in and parking

  1. You may park on Allen St. in front of The Workshop to unload.

  2. After unloading, move your car to street parking on 4th Street so customers have prime street parking on Allen St.

  3. The parking garage is privately owned. Do not park in the garage.

7. Spaces, equipment, power and Wi-Fi

  1. Outside (parking lot): a 10x10 space. You bring your own tent, tables and tent weights. Outdoor tents must be weighted, and we suggest at least 40 lbs per leg.

  2. Inside The Workshop: one 8-foot diameter semi-circle table and chair, provided by The Workshop.

  3. Booth placement is based on who applies first. We will also take into consideration traffic flow in booth placement decisions.

  4. Wi-Fi is available at The Workshop and in the parking lot. If you need power, tell us in your application.

  5. Secure your tents, tables and displays. You are responsible for any damage your equipment causes to people or property.

8. Products and prohibited items

  1. You are solely responsible for the safety, quality, labeling and legality of what you sell.

  2. Open flames are not permitted at the Market (for example, lit candles).

9. Permits, licenses and sales tax

  1. You are responsible for any permits or licenses your products or services require. Food vendors must comply with Texas Cottage Food Law.

  2. If you sell products, give us your Texas taxpayer number in your application.

  3. You are responsible for collecting and remitting your own sales tax. See the Texas Comptroller's guidance, Fairs, Festivals, Markets and Shows.

10. Insurance, assumption of risk and indemnification

  1. We encourage vendors to carry their own liability insurance. Service vendors must carry the licenses and insurance that apply to their services.

  2. You participate at your own risk. The Workshop and the Market are not responsible for loss, theft, damage or injury to you, your staff, your products or your property before, during or after the event.

  3. You agree to hold harmless and indemnify the Market, The Workshop, and its owners, staff and volunteers from any claims, damages or expenses arising from your participation, products or conduct, including claims from customers about products they purchased.

11. Conduct
Treat staff, other vendors and attendees respectfully. The Market may remove anyone who violates these terms, without refund.

12. Photo consent
You may be photographed during the event. You give the Market permission to use event photos and your likeness for promotional purposes.
13. Communication and day-of contact

  • On acceptance: we will email you a confirmation with a request to tag us on social media.

  • Leading up to the Market: we will send additional social tagging requests about once a week.

  • The week before: we will send a final logistics email.

  • Market day contact: Heather Lyles, 512-554-8451.

14. Agreement
By signing the application, you confirm that you have read and agree to these terms.
